Please Read Carefully Pharo is a general wellness application. It is not a medical device and does not diagnose, treat, cure, or prevent any disease or health condition. The app does not predict health outcomes. You define labels; the app finds statistical correlations in your data that match those labels. Always consult qualified healthcare professionals for medical advice.

1. Agreement to Terms

By accessing or using Pharo ("the App," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Nature of the Service

2.1 What Pharo Does

Pharo is a personal wellness tool that:

Reads health metrics you choose to share from Apple HealthKit
Allows you to create custom labels for any pattern you wish to track
Generates statistical models based on correlations between your health metrics and the labels you provide
Displays when your current metrics statistically resemble patterns you have previously labeled

2.2 What Pharo Does NOT Do

Pharo does not and cannot:

Predict future health events, symptoms, or conditions
Diagnose any disease, illness, or medical condition
Detect the presence or absence of any health condition
Provide medical advice, recommendations, or treatment guidance
Replace professional medical judgment or clinical testing

2.3 User-Defined Labels

You are solely responsible for creating and defining labels within the App. Labels are arbitrary text strings that you assign meaning to. When you label a day as anything (examples might include "bad day," "good day," "tired," or any other term), you are simply creating a marker in your data. The App then identifies statistical patterns in your health metrics that correlate with days you have labeled.

The App has no knowledge of what your labels mean. It cannot interpret whether a label refers to a symptom, feeling, event, or anything else. It simply finds mathematical correlations.

2.4 Illustrative Examples

Any examples, use cases, or scenarios mentioned in marketing materials, documentation, or the App itself are purely illustrative. They demonstrate how the App functions mechanically, not what outcomes you should expect. The inclusion of any example does not imply the App is designed for, effective at, or capable of addressing any particular health concern.

3. No Medical Claims

3.1 Not a Medical Device

Pharo is classified as a general wellness product. It has not been evaluated by the U.S. Food and Drug Administration (FDA) or any other regulatory body. It is not intended to diagnose, treat, cure, or prevent any disease.

3.2 Not Medical Advice

Nothing in the App constitutes medical advice. The statistical correlations displayed by the App are not diagnoses, prognoses, or clinical findings. They are mathematical relationships between numbers.

3.3 Consult Healthcare Providers

If you have health concerns, symptoms, or questions about your wellbeing, consult a qualified healthcare professional. Do not use information from this App to make medical decisions. Do not delay seeking medical care based on anything displayed in this App.

4. User Responsibilities

By using Pharo, you agree to:

Use the App only for personal, non-commercial wellness tracking
Provide accurate information when creating labels
Understand that you are responsible for any meaning you assign to labels
Not rely on the App for medical decisions
Not attempt to reverse-engineer, copy, or misuse the service
Maintain the security of your account credentials
Comply with all applicable laws in your jurisdiction

5. Subscriptions and Payments

5.1 Subscription Options

Free Tier: Basic features including viewing baseline statistics and creating labels
Pro Subscription: $9.99/month or $79.99/year, includes model calibration and additional features

5.2 Billing

Subscriptions are billed through your Apple ID account
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
You can manage and cancel subscriptions in your Apple ID account settings
No refunds are provided for partial subscription periods

6. Intellectual Property

The App, including its design, code, algorithms, and machine learning models, is owned by Pharo and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes.

You retain ownership of your personal data, labels, and any content you create within the App.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The App will meet your requirements or expectations
The App will be uninterrupted, timely, secure, or error-free
Any correlations or patterns identified will be accurate, meaningful, or useful
Any defects will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHARO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, data, or goodwill
Personal injury or health outcomes
Any decisions made based on information from the App
Any reliance on the App's outputs

Our total liability for any claim arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Pharo and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.

10. Modifications to Terms

We may update these Terms at any time. We will notify you of material changes by posting the new Terms in the App or via email. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.

12. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
